WASHINGTON, D.C., May 14, 2013—Statement of Nan Aron, President, Alliance for Justice concerning the Internal Revenue Service and 501(c)(4) organizations:

“The one thing we can be sure of is that the recent revelations about the IRS and 501(c)(4) organizations once again illustrate the need for clarity in the rules. The lack of standards opens the door to arbitrary decisions.

For years, nonprofit advocacy groups have called for the IRS to provide clear guidance around the “facts and circumstances” test because the current standard is so vague. The test, which has been the standard for what constitutes election-related activity, has created a compliance and enforcement nightmare for the advocacy organizations, as well as IRS staff.

As an organization that works to encourage and strengthen nonprofit advocacy, we can’t help but to be concerned about how the current controversy will impact the sector.
